Welcome to nimble, built and operated by Technous LTD. These Terms of Service govern your access to and use of the nimble mobile application and website. By using nimble, you agree to these Terms. If you do not agree, please do not use our services.

Eligibility

You must be at least 13 years old to use nimble. By using the app, you confirm that you meet this age requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

Services Overview

nimble is an AI-powered alarm app that delivers personalised wake-up experiences through voice messages and motivational content. Key features include:

•Personalised alarm messages generated using AI providers (ElevenLabs and OpenAI) based on your preferences and mood

•Calming pre-sleep content and morning motivation

•Morning Clubs - social features for sharing wake-up messages

•Sleep and health data tracking to help you understand your patterns. Some features require a paid subscription managed through Stripe and Adapty.

Account Registration

To access most features, you need to create an account using your email or a social login provider (such as Google or Apple). You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

User Content

You retain ownership of any content you provide to nimble (such as mood preferences and personal settings). Your inputs are processed by our AI providers to generate personalised alarm messages. This data is handled in accordance with our Privacy Policy and is not stored beyond what is necessary to deliver the service.

Acceptable Use

You agree not to:

•Use nimble for any unlawful purpose or to promote illegal activity

•Post or share content that is hateful, abusive, or discriminatory

•Attempt to interfere with, disrupt, or overload our services

•Scrape, reverse-engineer, or attempt to extract the source code of the app

•Use automated systems or bots to access nimble without permission. Violation of these rules may result in suspension or permanent termination of your account, at our sole discretion.

Intellectual Property

All content, features, branding, and functionality of nimble are owned by Technous LTD and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of nimble without our written permission.

Limitation of Liability

nimble is provided on an 'as is' and 'as available' basis. Technous LTD makes no warranties, express or implied, regarding the reliability, availability, or accuracy of the service. We do not guarantee that nimble will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, Technous LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of nimble, including but not limited to missed alarms, lost data, or interruptions to service.

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of nimble shall be subject to the exclusive jurisdiction of the courts of England and Wales.
