Introduction

Welcome to nimble, built and operated by Technous LTD. These Terms of Service govern your access to and use of the nimble mobile application and website. By using nimble, you agree to these Terms. If you do not agree, please do not use our services.

Eligibility

You must be at least 13 years old to use nimble. By using the app, you confirm that you meet this age requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

Services Overview

nimble is an AI-powered alarm app that delivers personalised wake-up experiences through voice messages and motivational content. Key features include:

•Personalised alarm-message text generated by xAI (Grok), with ElevenLabs used to turn that text into character audio, based on your preferences and habits

•Calming pre-sleep content and morning motivation

•Morning Clubs: social features for sharing your mornings

•Sleep, step and mindfulness insights from Apple Health, which stay on your iPhone. Some features require a paid subscription sold through the App Store.

Account Registration

To use nimble you sign in with Apple or Google. You are responsible for keeping access to that account secure and for all activity under your nimble account. You can delete your account at any time in Profile → Delete Account; our Privacy Policy explains what deletion removes.

Subscriptions

nimble Membership is an auto-renewing subscription sold through Apple's App Store.

•Payment is charged to your Apple ID when you confirm the purchase, or when a free trial ends

•It renews automatically at the same price and length unless auto-renew is turned off at least 24 hours before the current period ends

•Manage or cancel it in iPhone Settings → your name → Subscriptions. After cancelling, Membership stays active until the end of the period you have paid for

•Refunds are handled by Apple under its policies, at reportaproblem.apple.com

•Restore purchases in Profile brings a subscription back on a new device

•Deleting your nimble account does not cancel your subscription

•Apple's Standard Licensed Application End User License Agreement (EULA) also applies to your use of the app

User Content

You keep ownership of what you create in nimble, including habits, check-ins, messages to friends and posts in Morning Clubs. You give us permission to store, process and show it as needed to run the features you use, for example delivering a message to your friend or showing your post to a Club. Your inputs are processed by our AI providers to generate personalised alarm messages, as our Privacy Policy describes.

Morning Clubs & Friends

Morning Clubs and friends let you share your mornings with other people. To keep them safe:

•Club posts are shown to that Club's members with your username, unless you turn off Show My Username in Clubs in Profile. A message to a friend is seen by that friend

•Be kind and supportive. No harassment, hate, threats, sexual content, spam or promotion, and no messages that pressure, shame or frighten someone

•Don't share other people's personal information, and don't use Clubs for dating

•You can report any Club post (swipe left on it, or press and hold) or any message a friend sends you, and block anyone. We never tell anyone who reported them; people you block can no longer reach you, and you stop seeing their posts

•We have zero tolerance for objectionable content and abusive users, in Morning Clubs and in messages to friends. We review and act on every report within 24 hours. Offending content is removed, and the account that posted or sent it is ejected: it is removed from Clubs, can no longer send messages and may be closed. An account reported by three different people is removed from Clubs automatically

•You are responsible for what you post. Posts are filtered for offensive words but not reviewed by a person before they appear, and we do not endorse what members say

Acceptable Use

You agree not to:

•Use nimble for any unlawful purpose or to promote illegal activity

•Post or share content that is hateful, abusive, or discriminatory

•Attempt to interfere with, disrupt, or overload our services

•Scrape, reverse-engineer, or attempt to extract the source code of the app

•Use automated systems or bots to access nimble without permission. Violation of these rules may result in suspension or permanent termination of your account, at our sole discretion. Objectionable content and abuse of other users are never tolerated: as described above in Morning Clubs & Friends, the content is removed and the account ejected.

Intellectual Property

All content, features, branding, and functionality of nimble are owned by Technous LTD and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of nimble without our written permission.

Limitation of Liability

nimble is provided on an 'as is' and 'as available' basis. Technous LTD makes no warranties, express or implied, regarding the reliability, availability, or accuracy of the service. We do not guarantee that nimble will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, Technous LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of nimble, including but not limited to missed alarms, lost data, or interruptions to service.

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of nimble shall be subject to the exclusive jurisdiction of the courts of England and Wales.
